The meeting of the newly formed Supreme Judicial Commission headed by the Chief Justice of Pakistan Yahya Afridi is being held today. The agenda of the meeting includes setting up of the Secretariat of the Judicial Commission, nomination of judges for the Constitution Benches and discussing any additional matters.
According to the ongoing agenda regarding the meeting, senior judges, federal law minister, attorney general and bar council representatives and five members of parliament will participate in this meeting of judicial commission.
According to the agenda, among the members of the commission are Justice Syed Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Aminuddin Khan, Federal Minister for Law Nazir Tarar, Attorney General Mansoor Usman Awan, Senior Advocate Akhtar Hussain, Senator Farooq Naik, Senator Shibli Faraz, National Assembly. The members include Sheikh Aftab Ahmed, Umar Ayub Khan, and Roshni Khursheed Brocha on the women’s seat.
Important decisions regarding the nomination of judges for constitutional benches are expected in the meeting. The Heads of the Constitution Benches shall be the thirteenth members of the Commission.

Under the 19th Amendment, the Judicial Commission actually sent its nominations for each post of Supreme Court, High Court, or Federal Shariat Court judges to an 8-member parliamentary committee, which forwarded the names to the Prime Minister and then to the President. After the amendment, the commission will now send its nominations directly to the Prime Minister who will forward them to the President for appointment.
According to the Ministry of Law, any decision of the Judicial Commission under Article 175A Clause 2 and Clause 3D shall not be void even in case of absence of any member or vacancy of any post.
It should be noted that after the 26th constitutional amendment, for the first time in the history of Pakistan, the Chief Justice of the Supreme Court was elected by a parliamentary committee.
Letter from two senior judges to the Chief Justice
Two senior judges of the Supreme Court, Justice Mansoor Ali Shah and Justice Muneeb Akhtar, have written a letter to Chief Justice Yahya Afridi expressing regret and disappointment over the non-implementation of the decision of the Practice and Procedure Committee.
